Story passed on by Mrs. Edith McNutt of VA: Young Rachel was abandoned in a cave
near Neumans Ridge in Snoodville, TN (Hancock CO.) She was found by Ambrose Jones
and his wife. The Jones family took Rachel into their home and raised her as one
of their own.

Last Will and Testament of James Barnett,Jr. Book III, page 322, Scott Co., VA.

I, James Barnett of County of Scott and the State of Virginia, do make this my last Will and
Testament in names and form following that is to say:

First: It is my will that my funeral shall be conducted in a plain common way without
unnecessary parade or expenses and that my funeral expenses and all my debts be paid
out of my effects or those of my heirs that gets effects.

Second: I give, devise and bequeath to my beloved wife, Elizabeth the plantation
or part thereof where we now live bounded as follows to wit: beginning on top of
the Big Ridge corner of the land that I deeded to my son, Eli Barnett, southward
with said lines poles to his southwest corner; then eastward crossing the branch
poles to a corner of the land that I deeded to William Barnett, (should be
James William Barnett) my son and James Pierson, my son-in-law, then northward
with said poles to T. E. Reynolds line and my old line as it runs to a sugar tree
and as was B. B. Taylor's line in his lifetime, then northwardly including all
land on the north side of the Big Ridge poles to the beginning containing one
hundred acres or less during her natural life.

Third: I also will and bequeath to my beloved wife, Elizabeth: 1. To have and
to hold forever and that as the death of my said wife all the land that I give
to my wife is to be divided between my daughters, Phoebe and my granddaughter,
Mary, Peggy's girl as follows: Phoebe is to have all the land south side of the
Big Ridge on top of said ridge, as described in Mrs. Barnett dour; and all the
north side of the Big Ridge to Mary Barnett is to have from the line on top of
said Big Ridge down on the north side as described in Mrs. Barnett's dour.

Forth: I give and bequeath to my beloved wife, Elizabeth, all my household
and kitchen furniture to have to hold forever and last, I hereby constitute
and appoint Thomas Page my executor of this my last Will and Testament
this 11th day of November, 1886, signed sealed and delivered in the presence of us.

How the Places in Scott County Got Their Names by Omer Addington, Special
Writer
...."The county seat of Scott County has had three names. Scott County was
named for Gen. Winfield Scott. The county seat was called Winfield from 1814
to 1817. And from 1817 to 1886 it was called Estillville to honor Judge
Benjamin Estill who was instrumental in getting the county formed. Judge
Estill was an admirer of Gen. Scott and gave the county its
name."........."In 1886 the name was changed to Gate City because of
Moccasin Gap being a gateway to Kentucky and the west."

The Old Grandfather
A frail old man went to live with his son, daughter-in-law, and
four-year-old grandson. The old man's hands trembled, his eyesight
was blurred, and his step faltered. The family ate together at the
table. But the elderly grandfather's shaky hands and failing sight
made eating difficult. Peas rolled off his spoon onto the floor.
When he grasped the glass, milk spilled on the tablecloth. The son
and daughter-in-law became irritated with the mess.

"We must do something about Grandfather," said the son. "I've had
enough of his spilled milk, noisy eating, and food on the floor."
So the husband and wife set a small table in the corner. There
Grandfather ate alone while the rest of the family enjoyed dinner.
Since Grandfather had broken a dish or two, his food was served in a
wooden bowl. When the family glanced in Grandfather's direction,
sometimes he had a tear in his eye as he sat alone. Still, the only
words the couple had for him were sharp admonitions when he dropped
a fork or spilled food.

The four-year-old watched it all in silence. One evening before
supper, the father noticed his son playing with wood scraps on the
floor he asked the child sweetly, "What are you making?"

Just as sweetly, the boy responded, "Oh, I am making a little bowl
for you and Mama to eat your food in when I grow up."

The four-year-old smiled and went back to work. The words so
struck the parents that they were speechless. Then tears started to
stream down their cheeks. Though no word was spoken, both knew what
must be done. That evening the husband took Grandfather's hand and
gently led him back to the family table. For the remainder of his

days he ate every meal with the family. And for some reason, neither
husband nor wife seemed to care any longer when a fork was dropped,
milk spilled, or the tablecloth soiled.

Barnett Cemetery - Duffield # 70 (better known as Barnett Cemetery on Big Ridge,
where many family is buried).

Located on Big Ridge. My great great great grandparents James and Jane Barnett
owned that section,2,000 acres, of Big Ridge. Their son John Barnett married
Elizabeth A. Johnston/Johnson. Have found legal documents found in both
spelling for same people. This list is by rows.

Notes for Thomas L. Gilliam:
Thomas became a member of the 48th VA Inf of Scott Co., VA. Private Thomas D. Gilliam
age 18, was absent without leave from his infantry division on several occasions.
He was captured by Captain Smith in England Valley where he had a dugout in a
bank under a Mulberry tree. Thomas was brought to the south side of what was known
as "Big Ridge" near the McNutt farm close to the Tennessee-Virginia line.
Captain Smith's horse bolted and ran back up to the top of the ridge in a chestnut grove,
where the McNutt family is presently buried. Captain Smith and one of his men went
after the horse. Captain Smith, it was said, had given his men explicit orders
not to harm Thomas Gilliam.

While up on the ridge, Captain Smith and his charge heard a shot where the men had been
left. Captain Smith told his companion, "There...... they've gone and shot
Tom Gilliam and it will take my life to pay for it."


Thomas Gilliam, age 18, had been shot and his body thrown into the forks of young
dogwood tree, which stood until cut down in the 1920's. The land is still owned
by the Lyon family. The death of Thomas Gilliam is on record in Scott County, VA.
Captain Smith was later shot and his murders never found. Historical rumor says
that his body was thrown into a cave in the sinks (a sort of marsh), and was
never seen again.

According to records, Eli's grandson, John murdered two Frazier brothers

Confederate soldier, answered muster call on April 19, 1865 Gate City,
Scott Co., VA. Scott Co. Court House.

Daniel was a member of the Nickesville Spartin Band ( a band of young men who lived
in and around Nickelsville, VA.). This small band made up of young volunteers,
served in the Confederate Army for a period of one year.

Just before sunrise, on 13 July, 1861, they elected their officers and
gathered together the majority of their worldly goods and with heads held high,
marched off to join the Army of Virginia Volunteers in Abington, Virginia.
They became Company H of the 48th Regiment of Virginia Volunteers, which would
be known as part of General Stonewall Jackson's army. This army participated in
the battle of Shenandoah Valley Campaign of 1862.

The Nichelsville Spartin Band also fought in the Battle of Romney, Kernston,
McDowell, Font Royal, Cross Keys, and the Port Republic;
the second battle of Manass (better known as the Battle of Bull Run on 29 August 1862),
the Great Wilderness Campaign, and the Battle of Gettysburg, which became know as
the bloodiest battle of the Civil War.

Of the seventy-six young men (in the Nichlesville Spartin Band) who so
bravely marched off to war, only one answered the muster call at Appomattox
when General Robert E. Lee surrendered the southern forces on 19 April 1865.

William Wallace (Bob) Barnett, 99, of Rt. 3, Mt Vernon died June 11, 1991, at Berea Hospital.
He was born on May 18, 1892 in Rockcastle County, the son of the late
James and Mary Chasteen Barnett. He was retired farmer, carpenter, and ferrier.
He was a member of the Roundstone Baptist Church.
Survivors are: three sons, Edgar Barnett of Rt. 3, Mt. Vernon,
Isaac Barnett of Paint Lick, and Bodie Barnett of Berea; two daughters,
Mrs. Alta Philbeck of Mt. Vernon and Mrs. Margie Callahan of Berea; a brother,
George Barnett of Crab Orchard, 15 grandchildren, 31 great grandchildren,
and 5 great-great grandchildren. He was preceded in death by his wife,
Mrs. Nellie VanWinkle Barnett and by a son.
Services will be held Friday, June 14, at 11 a.m. at the Lakes Funeral Home
in Berea with Revs. Bill Hamilton and Harvey Pensol officiating. Burial will
follow in the Johnetta Cemetery. Friends may call after 6 p.m. Thursday (today)
at the funeral home.
Pallbearers are: Ray Philbeck, Thomas Philbeck, Estil Philbeck,
Eugene Philbeck, Lonnie Philbeck, Eddie Barnett, Hershel Dale Callahan and Michael Callahan.

March 28, 1996 at his home. He was born Rockcastle County on October 24, 1904,

of the Valley Baptist Church.
Survivors are one son, William Barnett of Copper Creek; one daughter,
Ruth Pingleton of Copper Creek; 13 grandchildren and 27 great grandchildren.

and a daughter Barbara Croley.
Services were held Monday, April 1, 1996 at the Dowell and Martin Funeral Home chapel

Notes for Sarah Jane Barnett:
Sarah Jane sure had a hard life being married to Fanteroy. He would take
off and marry another woman, never bothering with divorce. Maybe he
chased around because he was younger than Sarah Jane, or was he just a
great lover? Sarah Jane was with child,(Frank, died very young) when
Fanteroy took off and married wife # 2 woman.

Sarah held a great love for Kentucky, she instilled her love for the Blue
Grass state in her children. Oh how she hated to leave Kentucky. She
had 2 small children and another one on the way ( Sarah Elizabeth) ,as
she made her way across the country to join her husband in Texas. Fant
had shot a man for slapping Sarah Jane, the sheriff gave him the choice
of leaving the county, never to return or going to jail. Fant left his
wife and children in the care of his father-in law, sister and
brother-in-law, (Eli Wallace & Phoebe (Malicoat) Barnett. The man was a
known trouble maker.

Oct., 1995, Sara L. (Davis) Allen and I were driving through the hills
of Kentucky, talking about our Granny ( Sarah Elizabeth (Malicoat)
Davis), about the love Sarah Jane had for Kentucky, remembering Granny
saying she always wanted to see the Blue Grass of Kentucky, when I looked
up to heaven and said," Granny look through my eyes and see the beauty of
the Blue Grass of Kentucky".

From all the years of research I have done, I feel I have the right to
state how I see Fanteroy M. Malicoat, my great grandfather.

with 6 children. (one being my grandmother, Sarah E.) Name is under
spelling Malicot and family number 205-182, copied from Pauls Valley
library, Pauls Valley, OK.

1910 census lists Frank Malicoat as head of house, age 55, no wife.

Fantroy was a playboy, he was still married to Sarah Jane [she was
carrying Frank in her womb] when Fanteroy ran of and started
living with an "old Lady Blue". When this lady became pregnant and
Fanteroy refused to marry her, she took the life of her unborn child and
her own. After her death, Fanteroy returned yet to took another wife,
Elizabeth George and started yet another family. Records
show proof on the same 11-13-1900, Fanteroy took yet another wife,
Millie Beard in Maxwell, Indian Territory. No divorce has ever been
found for Fanteroy.

I found Fanteroy M. Malicoat and Elizabeth George's son Luther Malicoat
and his son, Travis Malicoat living in CA. 7-1996.

Three of Fanteroy and Sarah Jane [Barnett] Malicoat's daughter's married
three sons of James Robert Finley and Millie[Blackwell] Davis in
Indian Territory.

Mrs. Mary Davis died at her home east of Marlow Friday, January 15
after three years of illness. She was born near Franklin, Ky. March 29, 1880,
and was past 62 years old at time of her death. She was married to John David Davis
in Pauls Valley in 1899. The couple moved to Marlow from Pauls Valley 17 years ago.
They were the parents of two sons and six daughters who survive, Mr. Davis died
here several years ago. She is survived by 30 grandchildren and 2 great grandchildren.
Sons are Jessie Davis of Marlow and Lee Davis of Tracy, Ca., the daughters are
Mrs. Clara Newberry of Allen, Mrs. Florence Bishop of Oklahoma City,
Mrs. Pearl Cowan of Duncan, Miss Nora Davis of the home address,
Mrs. Lillie McGee and Mrs Fannie Hix both of Fredrick.
Two brothers, George Malicoat of Roff, and Mat Malicoat of Gertie, Ok.
and two sisters, Mrs. Joe Davis and Mrs. B.W. Beddo , also survive.
Funeral services were held Sunday afternoon at the Pentecostal Church of God
conducted by J. E. Madwell of Marlow. Burial was in Marlow cemetery.
The Steele Funeral Home was in charge of arrangements.

John David Davis Died Thursday afternoon following Two days acute illness.
John David Davis, Marlow farmer, died at his home two miles east of
Marlow last Thursday afternoon after an acute illness of only two days.
Mr Davis had been in poor health and suffering from high blood pressure
for the past three years. He was born Nov. 11, 1869 in Jackson Co., Ala.
and was 69 years, ten months and 17 days old at the time of his death. Mr
and Mrs Davis were married at Pauls Valley in 1899 and moved to Marlow in
1925. Surviving are his widow, Mrs. Mary Davis and eight children. The
children are Nora, Lillie and Jess, all of Marlow; Mrs. Clara Newberry of
Ada; Mrs. Florence Bishop of Oklahoma City; Mrs. Pearl Cowan of Duncan,
Mrs. Fannie Hix of Tipton and LeRoy Davis of Stockton, Ca. His four
brothers are Reason Davis of Jay, Ok.; Joe and Zack Davis both of Pauls
Valley, and Bill Davis of McFarland, Ca. He has 23 grandchildren living.
Funeral services in charge of the Steele Funeral Home were held Friday
afternoon from the Marlow Pentecostal Church of God with the pastor, Rev.
L. L. Huess conducting them. Pallbearers were T. P. Hervey, Jr; Frank
Newberry, Cecil Hanks, Bill Hanks, James Cowan and Ray McKinzie.
Burial was in the Marlow cemetery.

when the wagon train stopped over in Sugar Loaf, Ark. they settled there.
James took his family onto Texas, boarding the Santa Fe train onto Pauls Valley,

Story Told By: Mr. Joe Davis, born March 21,1881, ALABAMA

"I came to the Indian Territory with my father and mother in 1892. I was
11 years old, we came through on the Santa Fe train from Texas to Pauls
Valley, Indian Territory. On arriving at Pauls Valley, my father bought
2 horses and a wagon, we loaded up our household things, that my father
has shipped through. It was not much, we had 4 chairs, table, homemade
bedstead and a few other household things.

My father moved to Purdy, a little place about 25 miles southwest of
Pauls Valley. There was a store, lone schoolhouse, Blacksmith shop and a
Grist Mill. This mill was ran by steam and owned by Mr. Park (Hart). The
Blacksmith Shop was owned by Jim Welch. I do not remember who owned the
store.

I went to school at this Log School house. A white woman was my teacher,
I do not remember her name. My father had to pay her one dollar a month
for me. Us kids that went to school did not have desks, we used slates
and set on the hued down logs for seats. I had a blue back speller and a
reader. I think there was about 25 or 30 children went to this school,
the year I went. I did not go much the second term, only on the days we
could not work in the fields. I had to help my father on the farm.

My father had about 100 acres leased, he raised lots of corn and cotton.
He would haul the cotton to Pauls Valley on the Washita river. I believe
this mill and gin went out of business.

There was lots of deer around Purdy, when we moved there, I have seen as
high as 15 deer in one drove, around the foot of the Table Mountains,
south of Purdy. Wild turkey's I have shelled corn and feather, about one
mile from our house was a big turkey roast, they would come around our
corn crib early of a morning. We could have turkey anytime to eat we
wanted to. I have gone hunting and would not even shoot at a turkey. I
like rabbits better, there was lots of coon, possum and skunks around
Purdy.

I have broke wild horses for my father when I was 14 years old. Sunday,

that was our "fun day". After Sunday school a group of boys that lived
around Purdy, would meet at my house, nearly all owned saddle horses. We
would go out on the prairie, there was not very many fences then. We
would rope calves and have our rodeo, riding these calves on Sunday was
when I learned to ride. When I was at the age of 15, I was not afraid to
try any wild broncs or did I not care how big the steers were. We boys
would make up $5.00 purses for the best rider for that day. I have won
several times.

My father raised some cattle and hogs, but his main crop was corn. Corn
was cheap then, I have seen my father sell corn for fifteen cents a
bushel. My father sold about 20 Acers of corn for ten cents a bushel in
the filed. I do not know how much corn the man he sold that year
gathered, but we usually made forty to fifty bushels an Acer.

I lived with my father and mother around Purdy, until I was married in
1900. I married Lisa Sarah Malecoat, daughter of F.L. Malecoat, who was
a big cattle man around Purdy, when my father moved there. My wife was
born in Purdy, I do not know how long her people has been in the Indian
Territory, before my father and mother came there.

After getting married I moved on a farm and went to farming for myself.
In later years I have raised as high as 75 bales of cotton a year.

My wife and I have reared 10 children. I now live 3 miles west of Pauls
Valley. I have lived around in what is now Garvin county for 45 year. "

The third child born of Joe and Sally Daivs died at the age of 3 from a
spider bit.
Sarah Elizabeth (Malicoat) Davis wasn't born at Purdy, Okla., she was
born in TX.
Her mother was with child when Sarah Jane (Barnett) Malicoat left Ky by
wagon to TX to join her husband, Fanteroy. The child Sarah Jane Malicoat
was carrying was Sarah Elizabeth Malicoat, ( my grandmother).

This bit came from an old news paper found in my mom's picture box, no date,
but most likely about 1945, Pauls Valley, Garvin Co., OK.

Thelma Jackson, Mrs. Sanford Davis of Oklahoma City, Mrs. Lou Veda Gosnell,
Richmond, CA., Mr. and Mrs. Ralph Davis and children, Galveston,
Mr. and Mrs. Wayne Davis, Dallas, Mr. and Mrs. Edd Davis and children,
Mr. and Mrs. I. R. Clark and children, Mr. and Mrs. Preston Talley and son,
Mr. and Mrs. Jerome Roberts and daughter, Mr. and Mrs. Emmett Lewellen and children and
Mr. H. Barnett, all of Pauls Valley. A son, PFC. Sanford Davis, serving in Japan,
was only one unable to attend.

Thursday for Joe S. Davis, Pauls Valley resident and pioneer Oklahoman who died Tuesday.
Davis was born in Mississippi in 1881 and came to Oklahoma while still a child.
He was married to Sarah Elizabeth Malicoat in 1900.
J. M. Ward of Braggs, Okla. former pastor of the Pentecostal Holiness church here,
will conduct the services, assisted by Walter Little of Oklahoma City.
Survivors include his wife, seven daughters, Mrs. R. E. White of Canyon,
Texas, Mrs. Louveda Gosnell of Richmond, Calif., Mrs. I. L. Clark of Pauls Valley,

Wheelchair - Bound Woman Cares For Her Own Lawn by Curtis C. Wynne staff writer
Laurena Malicoat, 77 year old widow residing at 303 N.E. First St., has a few
words to say to homeowners in the City. "All those weeds people let grow in their
yards are bad for mine," she said. " Those weeds seeds just blow over into my yard,
and I'll bet I pulled a million weeds this spring." Mrs. Malicoat might have a
place to talk, too. She lives alone in a small, newly painted
white house sitting in the center of literally hundreds of blooming flowers
and a close-cut green lawn. She does her yard work from a wheelchair.
She does her housework from the same wheelchair. Coming to Carlsbad in 1950,
Mrs. Malicoat, a widow even then, worked at odd jobs care for the elderly
and baby setting, saving every penny she earned, and bought her house for
less than $3,000. "In ten years,: she said. "I finally have the house and yard
the way looking like I want them to." Mrs. Malicoat has been in the wheelchair
for five years. "I just woke up one morning and I couldn't stand up." Her son
and daughter built a small ramp leading from the ground up to the back door of
the house so that she would not fall down the steps. She stung a string from the
handle of the back screen door to the end of a hand rail so that she can open the
door before rolling the wheelchair up the ramp/ Yard work is not this energetic
woman's only hobby. She has a stamp collection, an art collection and a collection
of her own paintings. Mrs. Malicoat remains active in all her hobbies, too.
" I do just a little of nearly everything. But I don't mow the lawn." she said.
She hires young boys to come over to mow her lawn for her. Then she pulls the weeds
that crop up, and she keeps her flowers fed and watered. Mrs. Malicoat scoots

in court in charge of the Sheriff of this County and having fully heard the evidence,
instructions of the court and argument of counsel, were sent to their room to
consider of their verdict, and after some time returned into court and upon their
oaths did say, We the jury find John Barnett the defendant guilty of murder
in first degree as charged within indictment and fix his punishment
in the penitentiary for his natural life. Signed P. L. Hart, Forman."
And the defendant by counsel signifying his intention to move the court
to set aside the verdict of the jury rendered in this case, further action
is deferred until a future day of this term. And the prisoner was remanded in jail.


Cascal Enix acknowledged himself to be indebted to the Commonwealth
of Virginia in the sum of $250.00 and A. L. Compton, F. K. Elliott
and John Enix his sureties, each acknowledged themselves to be indebted
to the Commonwealth of Virginia in the like sum of $250.00 to be made and
levied of their respective goods and chattels, lends and tenements for the use of the
said Commonwealth, each waiving his right to benefit of the homestead exemption
as to this recognizance, but to be void if the said Cascal Enix shall
personally surrender himself into the custody of the Jailor of this County
on the 30th day of January, 1928, to finish serving his term of confinement

February 7, 1928, Judge E. T. Carter handed down "life imprisonment for your natural life."
Family stories handed down state that John Barnett served 20 year in prison, returned home
and led a rather quiet life, it's as told that every Frazier cousin stayed clear of him also.

Maggie V. Barnette Berry, 89, Rt. 3, Clinchport, VA., died Friday evening, Aug. 2,
at Holston Valley Hospital and Medical Center after a short illness.
She was predeceased by her husband, Ora E. Berry, Sr.
Surviving are six daughters, Mrs. Eunice (Bessie) Robinette and
Mrs. Orbin (Rosalee) Bledsoe, both of Blackwater, VA., Vivian Justice,
Church Hill, Mrs. Bill (Mable) Thurman, Rogersville, Mrs. Paul (Jean) Noody and
Mrs. Sheryl (Faye) Barker, both of Kingsport; two son, James H. Berry and
Ora E. Berry, Jr., both of Clinchport, VA.; 12 grandchildren;
four step grandchildren; 14 great-grandchildren; and three nieces.
Services were conducted at the chapel of Warren Funeral Home with the
Rev. Lester P. Smith and the Rev. Alex Willis officiating.
Grandsons served as pallbearers. Burial was in the Berry Family cemetery in Clinchport, VA.

Always spelt his name as Barnette

Just a little history lesson and reminder of what Lee county was before it
became Lee County in 1772. Information taken from " Bicentennial History of Lee
County Virginia 1772-1972" During 1750's this area was in Augusta County.
In 1770 this area was in Botetourt County for two years, then the entire
southwestern corner of Virginia was included in Fincastle County,
which was abolished in 1776 when Montgomery County and Washington County
included all counties Virginia west of Roanoke. Those who ventured into Powell Valley
and Turkey Cove (now Dryden) had to go to Abingdon (then Wolf Hills) to get their
land deeds recorded, or buy a marriage license. Also keep in mind that some of,
or parts of, the surrounding counties of Tennessee were also in VA at that time,
to include Hawkins, Hancock and Sullivan. Most of you may already know this
but just as a reminder to search other counties records around these time frames.

CLARA BARTON DAVIS
1918 - 1999
Graveside services will be held at Shafter Cemetery on Thursday, July 22, 1999 at
1:00 p.m. for Clara Barton Davis who passed away on July 18, 1999.
Clara was born on May 13, 1918 in Paul's Valley, Oklahoma and had been a
resident of Kern County since 1932. She had been a member of the
Pentecostal Church of God in Shafter. She is survived by her son, Wayne Davis
of California Hot Springs, CA; two daughters,
Clara Smithson of Leitchfield, KY and Donna Wheeler of Hanford, CA;
four sisters, one brother; eight grandchildren,
14 great-grandchildren and one great-great-grandchild. Visitation
will be held at Mish Funeral Home Oildale, 120 Minner Ave., on Wednesday,
July 21, 1999 from noon until 8:00 p.m.

In it's original location prior to being moved and restored
John & Elizabeth A. Johnston/Johnson Barnett moved into this cabin located on Wolf Creek Road,
Rockcastle Co., KY in 1856/57.  It was moved to Brush Arbor, Rockcastle Co., KY in the spring
of 1999 and is being restored and will be used as a museum.  John & Elizabeth's 4 youngest children
were born in this cabin.  Elizabeth is buried across the road from it's original location on Wolf Creek Road
