COOPER, Cornelius Page 21and Page 22 STATE OF OKLAHOMA. PUSHMATAHA COUNTY ss IN COUNTY COURT. CASE NUMBER NO. 562. In the Matter of the Estate of CORNELIUS COOPER, deceased (A-5573). ORDER APPROVING DEED. Now on this day there comes on for hearing the petition of ALLEN COOPER, LUCY COOPER and ELLEN FRAZIER nee COOPER praying the Court to approve petitioners' deed to W. H. WESTPHAL conveying said petitioners' interest in and to one hundred and sixty acres of land, situate in Atoka County, Oklahoma and being a part of the allotment of CORNELIUS COOPER, deceased, which said lands are specifically designated and described in said deed, a copy of which is attached to petition herein and made a part of the files in said cause; and said petitioners appearing in person and said purchaser appearing in this cause; and said petitioners appearing in person and said purchaser appearing and paying into Court the sum of $900.00 being the consideration named in said deed, and the Court having examined and considered said deed and petition set forth, and having heard the evidence offered in open court and being fully advised in the premises finds the facts to be as in said petition, to-wit: That petitioners are citizens by blood of the Choctaw Nation enrolled opposite Nos. 5576, 5574 and 5575 respectively, as of the full blood; that petitioners are the son, wife and daughter respectively, and the surviving heirs at law of said CORNELIUS COOPER, deceased; That said CORNELIUS COOPER was a citizen by blood of the Choctaw Nation enrolled opposite No. 5573 as of the full blood; That on or about the 27th day of June A. D. 1913 the said CORNELIUS COOPER departed this life intestate at his home near Nashoba in Pushmataha County, Oklahoma and had resided in that part of the Choctaw Nation now embraced within Pushmataha County, Oklahoma all his life; that this Court has Jurisdiction of the settlement of the estate of said CORNELIUS COOPER, deceased. That said CORNELIUS COOPER left him surviving as his heirs at law the following named persons and none other, to-wit: his son ALLEN COOPER, his wife LUCY COOPER and his daughter ELLEN FRAZIER nee COOPER; that ABEN FRAZIER, one of the grantors in the above named deed is the husband of ELLEN FRAZIER nee COOPER. That said CORNELIUS COOPER died seized of the following described lands, situate in the County of Atoka and State of Oklahoma, to-wit: The Northeast Quarter of Section 24, Township 3 South, Range 14 East of the Indian Base Meridian; That upon the death of said CORNELIUS COOPER said lands descended to his heirs at law hereinabove named, and become and are now alienable; That on the 9th day of September A. D. 1913 petitioners ALLEN COOPER, LUCY COOPER and ELLEN FRAZIER nee COOPER joined by her husband ABEN FRAZIER, made and executed their certain deed of conveyance conveying all their rights title and interest in and to the said above described lands to W. H. WESTPHAL for the price and sum of $900.00, which deed is now presented to this Court for approval; that petitioners have testified that they are entirely satisfied with said transaction and believe said consideration to be reasonable and adequate and the fair value of said land and that they desire to consummate said sale with the approval of this court; and the court being of the opinion that said sale is fair and equitable and that it will be for the best interest and proper benefit of said petitioners to approve said deed; Now therefore it is hereby ordered that the said deed of conveyance from the said petitioners above named to the said W. H. WESTPHAL conveying the said above described One Hundred Sixty acres of land be and the same is hereby ratified, confirmed and approved and in all respects declared legal and valid.
