THOMAS, James Page 14 STATE OF OKLAHOMA. PUSHMATAHA COUNTY ss IN COUNTY COURT. CASE NUMBER NO. 556. In the Matter of the Estate of JAMES THOMAS, Deceased. ORDER. Now on this 14th day of August 1913 comes ELIZA THOMAS, and files and present to the court her petition, praying for an order of the court approving and confirming a certain deed of conveyance executed by her to W. E. DICKERSON, on the 14th day of August 1913 to the following described real estate, to-wit: The South East quarter (SE 1/4) of Section Twenty-nine (29) in Township Four (4) South, and Range Nineteen (19) East. And the court upon consideration of said petition, and being fully advised the premises, finds that one JAMES THOMAS, a full blood Choctaw Indian, who appears upon the roll of Choctaws by blood, opposite Roll No. 1829 and a resident of near Corrine in Pushmataha County, State of Oklahoma, on or about the 5th day of July 1913, died intestate, seized of the lands above described, which lands were allotted to him by the Chickasaw and Choctaw Nations, and conveyed to him by allotment and homestead patent, and that the said JAMES THOMAS was at the time of his death the owner, in fee simple, of the above described lands. And the Court further finds that the said petitioners, ELIZA THOMAS, is the wife of the said JAMES THOMAS, deceased, and is the sole and only heir at law of the said JAMES THOMAS, deceased. The Court further finds that on the 14th day of August 1913, the said petitioner executed to W. E. DICKERSON for and in consideration of the sum of Seven Hundred Eighty ($780.00) Dollars cash in hand, to her paid her certain Warranty Deed to the said above described real estate. The Court further finds that the deed was duly signed and acknowledged by the petitioner and that the consideration for the deed is fully paid, and that the same is reasonable, adequate and wholly satisfactory to the said petitioner and finds further that the said conveyance of the said real estate to the said W. E. DICKINSON should be all things approved and confirmed. IT IS THEREFORE BY THE COURT CONSIDERED, ORDERED, ADJUDGED and DECREED, That the said conveyance of the said described lands by Warranty Deed dated the 14th day of August 1913 from the said petitioner to the said W. E. DICKERSON, his heirs and assigns, be and is hereby in all thing approved and confirmed, and declared legal and valid. Dated this the 14th day of August 1913 at Antlers, in Pushmataha County, State of Oklahoma. (Signed) L. P. Now on this 14th day of August 1913 comes ELIZA THOMAS, a widow and files and presents to the court her petition, praying for an order of the court approving and confirming a certain deed of conveyance executed by her to Wm. J. CASSIDY and E. E. WESTMORELAND, on the 14th day of August 1913 to the following described real estate, to-wit: SW 1/4 of SE 1/4 of SE 1/4 Section 17 and N 1/2 of NE 1/4 and N 1/2 of S 1/2 of NE 1/4 of Section 20, Township 2N Range 3 E. in Garvin and Murray Counties, Oklahoma. Also S 1/2 of NE 1/4 of SE 1/4 of NW 1/4 of Section 2, Township #S. R. 17 E., being the surplus allottment of JAMES THOMAS, deceased. And the court upon consideration of said petition, and being fully advised the premises, finds that one JAMES THOMAS, a full blood Choctaw Indian, who appears upon the roll of Choctaws by blood, opposite Roll No. 1829 and a resident of Pushmataha County, State of Oklahoma, on or about the 15th day of July 1913, died intestate, seized of the lands above described, which lands were allotted to him by the Chickasaw and Choctaw Nations, and conveyed to him by allotment patents and that she said JAMES THOMAS was at the time of his death the owner, in fee simple, of the above described lands. And the Court further finds that the said petitioner herein, ELIZA THOMAS, was the widow and the sole and only heir at law of the said JAMES THOMAS, deceased; That at the time the said decedent departed this life he was intestate and left no father or mother, brothers or sisters, child or children, or the descendants of any child or children or the descendants of any brother or sister. The Court further finds that on the 14th day of August 1913, the said petitioner executed to Wm. J. CASSIDY and E. E. WESTMORELAND, for and in consideration of the sum of Six Hundred Dollars, cash in hand to her paid her certain Warranty Deed to the said above described real estate. The Court further finds that the deed was duly signed and acknowledged by the petitioner and that the consideration for the deed is fully paid, and that the same is reasonable, adequate and wholly satisfactory to the said petitioner and finds further that the said conveyance of the said real estate to the said Wm. J. CASSIDY and E. E. WESTMORELAND, should be all things approved and confirmed. IT IS THEREFORE BY THE COURT CONSIDERED, ORDERED, ADJUDGED and DECREED, That the said conveyance of the said described lands by Warranty Deed dated the 14th day of August 1913 from the said petitioner to the said Wm. J. CASSIDY and E. E. WESTMORELAND, their heirs and assigns, be and is hereby in all thing approved and confirmed, and declared legal and valid.
