Sir: I hereby make application for such share as me be due me of the fund appropriated by the Act of Congress approved June 30, 1906, in accordance with the decrees of the Court of Claims of May 18, 1905, and May 28, 1906, in favor of the Eastern Cherokees. How old are you? 22 yrs. Born: 1886 6. Where were you born? Cooweescoowee District 7. Are you married? YES 8. Name and age of wife of husband- W. C. Murphy, 29 9. To what tribe of Indian does he or she belong? White 10. Name all your children who were living on May 28, 1906, giving their ages: Charles Thomas [Murphy] 3 years b. March 17, 1905 11. Give name of your father and mother, and your mother's name before marriage: Father-English name- Thomas J. Rogers Indian name- None Mother-English name- Minnie Indian name- White-none Maiden name- Minnie Spunangle 12. Where were they born? Father born in Cooweescoowee District, Indian Territory Mother born in Iowa 13. Where did they reside in 1851, if living at that time? NOT BORN 14. Date of death of your father and mother: Father is living, mother died August 3, 1897 15. Were they enrolled for money, annuities, land or other benefits? If so, state when and where and with what tribe of Indian. Yes, all payments from '83 to Strip payment, with Cherokee Indians at Vinita, Cherokee Nation. 16. State English and Indian name of your grandparents on both father's and mother's side, if possible: Father's side- Lewis Rogers, no Indian name, and Jane Rogers (white) Grandfather-John Rogers and Diana Rogers (grandmother) *(This would be Alva's great grandparents, listed as John Rogers and Tianna Foster) Mother's side- *(not listed, as they are white persons) 18. Where were they born? OLD CHEROKEE NATION 19. Where did they reside in 1851, if living at that time? Delaware District. Diana Rogers drew money '51 or 2 at Fort Gibson, Indian Territory 20. To assist in authentication, claimant should give the full English and Indian names, if possible of their parents and grandparents back to 1835. Diana Rogers was a Foster born in Old Cherokee Nation and came to this country as an emigrant. REMARKS (Under this head the applicant may give additional information that he believes will assist in proving his claim). My Cherokee roll number is 9518. I was enrolled by Dawes Commission and allotted land, also my oldest child. Note: Answers should be brief but explicit: the words 'yes' , 'no', and 'unknown' may be used in cases where applicable. Read the questions carefully. I solemnly swear that the foregoing statements made by me are true to the best of my knowledge and belief. The affidavit here, is unsigned, however the persons appearing on her behalf, have signed it on July 22, 1908. On another date, August 19, 1907, the affidavit IS signed by Alva M. Murphy and two others. A letter was written, July 7, 1908 asking questions, and they have been answered in this application.) Signed: J. L. McNelis, J. Personally appeared before me Daniel Spunangle and Lizzie Spunangle, who being duly sworn, on oath depose and say that they are well acquainted with Alva M. Murphy, who makes the foregoing application and statements, and have known her for 20 years and 20 years, respectively, and know her to be the identical person she represents herself to be, and that the statements made by her are true, to the best of their knowledge and belief, and they have no interest whatever in her claim. Murphy, who makes the foregoing application and statements, and have known her for 12 years and 21 years, respectively, and know her to be the identical person she represents herself to be, and that the statements made by her are true, to the best of their knowledge and belief, and they have no interest whatever in her claim.
