I hereby make application for such share as me be due me of the fund appropriated by the Act of Congress approved June 30, 1906, in accordance with the decrees of the Court of Claims of May 18, 1905, and May 28, 1906, in favor of the Eastern Cherokees. The evidence of identity is herewith subjoined.

James Kell lived in Cherokee Nation East in 1835.

My grandfather, James Kell, had a brother John Kell who died without descent. Alice French, Helen D. French, and James Kell were only my paternal half aunts and uncle.

Isbell, who being duly sworn, on oath depose and say that they are well acquainted with Joella Nall, who makes the foregoing application and statements, and have known her for 38 years and 20 years, respectively, and know her to be the identical person she represents herself to be, and that the statements made by her are true, to the best of their knowledge and belief, and they have no interest whatever in her claim.

Bell who, being duly sworn, on oath depose and say that they are well acquainted with Joella Nall, who makes the foregoing application and statement, and have known her for 20 years and 20 years, respectively, and know her to be the identical person she represents herself to be and that on May 28, 1906, she had the children living as above set forth, and that the statements made by her are true, and they have no interest whatever in her claim.

Eliza Andre being duly sworn, deposes and says:

"My name is Eliza Andre. I am 61 years old. I live at Fort Gibson. I know Dora Pennel. She is about 24 years old. Her name was Dora French before marriage. She is a sister to Tom B. French. She was born and raised near Fort Gibson, in Illinois District. She was enrolled by the Dawes Commission but I do not know her roll number. She got the bread and strip money. She has never associated or joined any other tribe than the Cherokees. She is a Cherokee Indian. She gets her blood from both mother and father. Her mother was Alice Kell. She is dead, died more than 30 years ago. There are Thomas B. French and James K. French, brothers to Dora Pennal, having same mother and father. Alice Kell was an Old Settler and got her blood from her mother, Julia Rogers. She was an Old Settler. Alice Kell's father was James Kell. Julia Rogers was James Kell's second wife. She was the Old Settler. James Kell was an emigrant I don't know how long he has been dead, but I think he died during the war. He was born back East, in Georgia or Tennessee. He came with the emigrants sometime between 1835 and 1838. I don't know whether he was enrolled in 1851 but think that he was. James Kell was married twice. Dora Pennal is by his second wife. I don't remember who his first wife was. The children by his first wife are Louis, John, Connie and Joe; Louise, Frank or Frances, and Nan or Nancy. They children by the second wife are Alice, Kate, and Jim Jr. Thomas Fox French was Dora Pennal's father. Dora Pennel's brothers and sisters are Bernice Howard, Mackie McDonald and Cricket or Nannie. Tom Fox French was probably not enrolled in 1851, being too young. His brothers were Robert French, Henry French, Mary French, Tom himself, and Cabble and Joe and Dick, Gypsey a girl, and Jeff French. He got his blood from his mother. His mother was Margaret French nee Fields and she was a Cherokee and I understand an Emigrant. She was born in the Old Country. She came about the time the Emigrants came in 1836 or 1838. She never associated with any other tribe. I don't know her parent's names. I understood that they were parties to the treaties of 1835-36 and 1846. It was always understood that they were emigrants and I understood they all got money. I never heard the old folks say whether they got any. James Kell had a brother Dave Kell. Louise Gillespie is a daughter of James Kell. James Kell did not have any Indian name that I know of. I think the Frenchs and Kells were on the 1851 roll.
