Charley Carter Shot by Marshal Will Collins While Resisting Arrest

A tragedy was enacted on the picnic grounds late Saturday afternoon which cost Charley Carter, pump mad of the Santa Fe at Davis,  
his life, and a feeling of regret of Marshal Collins for the necessity.

At the preliminary trial of Marshal Collins, held in Squire Patterson's court, witnesses testified that Carter was drunk and creating a disturbance.  That when Collins come up where Carter was standing he told Carter he would have to go with him; that the deceased refused while holding an open knife in his hand; that Collins then ordered him to throw up his hands or he would shoot; that Carter replied 'shoot and be dammed."  Carter then struck at Collins with his knife.  Collins hit Carter with his six shooter.  Carter staggered back then rushed forward with his knife and made 3 cuts at Collins slashing his coat, Collins retreating - then came the fatal shot and Carter fell mortally wounded with a bullet hole through his stomach, several intestines being severed.

Carter was taken to the sanitarium where opiates were administered preparatory to an operation.  However the man through grievously wounded was still under the influence of whiskey and force had to be used before the operation could be performed which was conducted by Drs. Dovst and Nowell.

It was unfortunate occurrence all around but the inevitable result of bad whiskey on the part of the deceased who while sober was a well dispostioned man but under the influence of whiskey was quarrelsome and a troubleseeker.

At his own request Marshal Collins was bound over to the October term of court, where the matter will be settled forever.

Carter was well known here, his first wife having been a daughter of  T.C. Carder, and who is buried in the  Wynnewood cemetery.  He leaves a young wife at Davis.
