Monday, February 1st, 1909.

BE IT REMEMBERED, That on this the first day of February 1909, the District Court of Pushmataha County, State of Oklahoma, convened in regular session in the District Court Room at Antlers in said County and State, pursuant to law. Present and presiding the Honorable Malcolm E. Rosser, District: Also present P. W. Hudson, Clerk; A. J. Arnote, Esq; County Attorney; and William Ellis, Sheriff: and public proclamation of the convening of said Court having been made, and said Court having been opened in due form of law, the following proceedings were had, to wit:

ORDER EMPANELLING GRAND JURY.

Now on this the 1st day of February 1909, comes William Ellis, sheriff of Pushmataha County, State of Oklahoma, and returns into open court the Venire for Grand Jurors for the February 1909, Term of the District Court of Pushmataha County, State of Oklahoma, duly selected, drawn and summoned as provided by law; and now the following named persons held in custody awaiting the action of the Grand Jury are brought into open Court, to wit:

O. B. Summers
Roy Summers
Bill Williams

And now the Venire is called by the Clerk and the following named person lawfully selected, drawn and summoned for Grand Jurors are found present, to-wit:

C. H. Chapman
M. B. Crawford
C. A. Finley
William Gardner
J. C. Goodgoin
James W. Grant
H. L. Hill
W. T. Hughes

E. J. Lindley
W. H. Maynard
J. C. McGuyer
William Nichols
C. C. Plumley
H. Reed
A. W. Thomas
B. M. Tucker
Arch Young

and are duly sworn by the Clerk to answer truthfully all questions that may be asked them touching their competency and qualifications as Grand Jurors, and thereupon they are interrogated by the County Attorney and by the Court touching their qualifications as Grand Jurors, and now they are tendered for examination and for challenge to the prisoners aforesaid then and there present, and to any other persons present who have reason to believe that any act of theirs will come before said Grand Jury for investigation, and no objection is offered to any of said Grand Jurors by any persons; and now the Court deeming it expedient, doth excuse and discharged the following named persons summoned as
Grand Jurors, to-wit:

And now the following named persons, twelve in number, lawfully selected, drawn and summoned, being without legal excuse, and being shown to posses all the qualification for Grand Jurors as required by law, are taken, to-wit:

4) W. H. Maynard
5) W. A. Butler
6) W. T. Hughes
7) C. W. Bagwell
8) A. W. Thomas
9) William Gardner
10) J. C. McGuyer

And now (A. W. THOMAS) is by the Court appointed foreman of the Grand Jury and is sworn as such in the manner provided by law, and now the remainder of the panel are sworn in the manner provided by law; and the said twelve persons are lawfully empaneled as the Grand Jury for the February 1909, Term of this Court, and are now charged by the Court touching their duties, and now Lem Anderson is by the Court appointed Bailiff for the Grand Jury and is duly sworn as such, and thereupon the Grand Jury retire in charge of their sworn bailiff to take up the business before them.
