JOURNAL 2 Pushmataha County, Oklahoma Transcribed by: Teresa Young Page 203 & 204. GRAND JURY REPORT NO. 3. Now on this the 7th day of September 1910, comes the Grand Jury heretofore lawfully empanelled in charge of their sworn bailiff, and their foreman, J. H. Miller, all members twelve in number being present, return into open court the following Indictment, each marked, "A TRUE BILL" and signed by their foreman, to-wit: No. 88, State of Oklahoma vs Rosie Jenkins, Aggravated Assault No. 89, State of Oklahoma vs Will DeArmond, Larceny No. 90, State of Oklahoma vs Wash Hardy, Carrying Gun No. 91, State of Oklahoma vs ----------, Unlawfully Keeping and Disposing Drugs All of which indictment are by the court ordered filed in open court in the presence of the entire panel of the Grand Jury, which is accordingly done. And it is further ordered by the Court that Bench Warrant issue for all defendants at large charged by said indictment, with a felony, and the Grand Jury to-wit: State of Oklahoma vs W. A. Smith, Assault to Kill State of Oklahoma vs Bee Human, Assault Whereupon the Grand Jury retired in charge of their sworn bailiff to take up further business before them. EMPANELLING PETIT JURY For the September 1910, Term of the District Court of Pushmataha County, Oklahoma Now on this 7th day of September 1910, comes William Ellis, Sheriff of Pushmataha County, State of Oklahoma, and return into open court the Venire for Petit Jurors for the September 1910, Term of the District Court of Pushmataha County, State of Oklahoma, duly selected, drawn and summoned as provided by law; and now the said Venire being called by the Clerk; and the following named persons lawfully selected drawn and summoned for Petit Jurors were found present, to-wit: J. C. Ballard J. A. Boatright Sim Bohanan J. I. Byrd Gates Carlisle J. W. Colbert W. N. Daniels Earle Earhart Homer Earhart M. A. Flemming Reason Frazier C. G. Goad R. T. Herman W. L. McBride G. P. McKinzie R. A. Moyer A. A. Poe J. W. Rothwell J. C. Simpson R. W. Steel Walker Tennison Z. L. Williams And are duly sworn by the Clerk to answer truthfully all question that may be asked them touching their competency and qualifications as Petit Jurors and thereupon they were interrogated by the Court and by the County Attorney, touching their qualifications as Petit Jurors, and now the court deeming it expedient doth excuse and discharge the followed named persons summoned as Petit Jurors, to-wit: Gates Carlisle And thereupon the above remaining Jurors were duly empanelled as Petit Jury for the September 1910, Term of the District Court of Pushmataha County, State of Oklahoma.
