IN VACATION.

State of Oklahoma, County of Pushmataha

In Re-Drawing of Petit Jury for September Term of District Court in and for said County.

I, Malcolm E. Rosser, Judge of the District Court within and for Pushmataha County in the State of Oklahoma, hereby certify to Peter W. Hudson, Clerk of the District Court within and for said County that forty persons are necessary to constitute the petit jury for the September A. D. 1909 term of the District Court in and for said County, and I hereby order and direct that the said Clerk and Wm. Ellis, Sheriff of said Pushmataha County, draw the names of forty persons from the jury box of the District Court of Pushmataha County on Wednesday, September first, A. D. 1909, at Nine o'clock A. M. I further order and direct that said drawing be conducted in all respects as provided by law.

I further order and direct that as soon as said drawing is completed that the said Clerk issue a Venire for the persons whose names are so drawn summoning them to be and appear before the District Court of Pushmataha County at the District Court room in the town of Antlers on Monday, September 13th, A. D. 1909 at Nine o'clock A. M. to serve as petit jurors for said September term of District Court. I further order and direct that said Clerk and Sheriff each make and keep a record of all his proceedings hereunder, which together each make and keep a record of all his proceedings hereunder, which together with this order shall be recorded on the journal of said District Court.

In Re the Drawing of the Petit Juries, for the September, 1909, Term of the District Court of Pushmataha County, Oklahoma.

SUMMONS TO DRAW JURIES
To the William Ellis, Sheriff of Pushmataha County of the District Court within and for Pushmataha County, Oklahoma, on the first day of September, 1909, at 9 o'clock A. M., of said day to assist in drawing the Petit Jury for the September 1909 Term of the District Court, to be begun and held in Antlers, in said Pushmataha County, State of Oklahoma, on the 13th day of September 1909.

Witness my hand and the seal of said court this the 31st day of August 1909.

This is to certify that I have this day accept service of the above summons, this the 31st day of August 1909.

In Re The Drawing of the Petit Jury for the September 1909, Term of the District Court of Pushmataha County, Oklahoma

I, Peter W. Hudson, do hereby certify that I am duly elected, acting and qualified Clerk of the District Court in and for Pushmataha County.

That pursuant to an order of the Honorable Malcolm E. Rosser, Judge of the District Court of said County and State, dated August 30th, 1909, I summoned William Ellis, Sheriff of said county to be and appear at my office in said county, on the 1st day of September, 1909, at 9 o'clock A. M., to assist in drawing the Petit Jury for the September 1909 Term of said court.

Thereupon I, Peter W. Hudson, Clerk of the District Court and the said William Ellis, sheriff of said county, took the jury box, containing on separate slips of paper the names of the persons selected and returned on the 6th day of July, 1909, by the jury Commissioners of said county, to serve as jurors, and did thoroughly shake the same. We then together in the presence of each other opened said jury box and after placing the same in such position that neither of us could see into it, we drew therefrom alternately, beginning with the said Peter W. Hudson, District Clerk and followed by said William Ellis, sheriff, one name at a time and recorded the same, which drawing and recording continued until the required number of Petit was drawn and recorded.

We thereupon destroyed all the slips of paper containing the names of the Jurors so drawn from said box and securely locked said box as required by law.
