Christopher Lotspeich Will


Monday 26th April 1830, the execution of the last will and testament
of Christopher Lotspeich died, and duly proven by the oath of James
Williams and Caleb Harrison, subcribing Nilinfore character and
ordered to be recorded and is as follows:
In the Name of God, I Christopher Lotspeich of the county Green
and state of Tennessee, being weak in body but sound in mind
margiery and recolection believing my stay on this world to be
short and percarious wishing to do justive and to keep down
discord among my legal heirs do make and ordain and declare
this instrument to be my last will and testament utterlyreaching
all former wills by me made and all former executors by me
appointed I declare this to be my last will and testament. First
of all I recomment and resign my soul into the hands of the Good
Lord that first gave it and my body to the earth to be entered in
a decent christian like manner. And as touching my estate that it
hath pleased God to bless me with I dispose of in the following
manner.

First I give and bequeath unto my beloved wife all the household
furniture that I may die peased and passied of all my horse and
her saddle & bridle in addition of I alligation that I hold on my
son Samuel Lotspeich for her life maintenance. Secondly I give
and bequeath unto my oldest daughter Elizabeth Hoover the sum of
five hundred dollars to be paid and of my estate as soon as it can
reasonably be collected to her and her children. Thirdly I give and
bequeath unto the children of my son Ralph Lotspeich dec'd the sum
of five hundred dollars to be paid as soon as it can be reasonably
collected. 4th, I give and bequeath unto my daughter Mary Walker
the sum of five hundred dollars to be paid as soon as it can
reasonably be collected to go to her and her childred.
5th I give and bequeath unto my daughter
Sarah Whittenburg the sum of five hundred dollars to be paid when
my money is collected to go to her children. 6th I give and
bequeath unto my daugher Barbary Boyles the sun of five hundred
dollars to be paid when my money is collected. 7th I give and
bequeath unto my daughter Susanna Pardoe the sum of five hundred
dollars to be paid when my money is collected to go to her and
her children. 8th I give and bequeath until the children of my
daughter Rachel Earnest the sum of five hundred dollars to be
equally divided among them when my money is collected. 9th I
give and bequeath to my daughter Rebecca Farnsworthy the sum of
five hundred dollars to be paid out of my estate when collected.
10th I give and bequeath unto my granddaughters Eliza J. Wills and
Susanna Wills the sum of one hundred dollars that is to say
fifty dollars each. 11th the residue of my estate be it little or
much to be equally divided amongst al my children or their legal
heirs that is to say the children of Ralph Lotspeich on share and the
children of Rachel Earnest one share and John Lotspeich, William
Lotspeich, Sameul Lotspeich and James Lotspeich, Elizabeth Hoover,
Mary Walker, Sarah Whittenburg, Barbary Broyle, Susanna Pardoe, and
Rebeckah Farnsworth except te following ites of my will.
12 My negro man called John and my negro woman named Patsy and my negro
girl caled Meriah I will and bequeath them their freedom at my death
and enjoining and duly on executors to have it recorded in court as soon
as practable after my death. 13th I appoint and institure my trusted
friend Stephen Brooks my sale executor of this my last will and
testament and do not require that she shall be required to give bond
or surity for same. Signed sealed and published by the said Christopher
Lotspeich as his last will and testament in the presence of is is the
following words was interlined before signed in Ralphs childrens legacy the
ward paid in Sarah Whittinburg, the work paid in Mr Broyle legacy the words
to be in the children of Mr Earnest legacy the ward divided in this seventh
item the ward estate.

Tuesday 27th april 1830, Stephen Brooks this Executor of the
Last Will and Testament of Christopher Lotspeich dec'd
appeared in Court and declined taking upon himself the execution
of said will. Therfore a motion of John Lotspeich and Samuel
Lotspeich who intered unto bond with Henry Earnest Sr. and Willaim
Lotspeich their securities in the sum of 10 thousand dollars payable
and contitionally as the law directs. Administration is granted them
with the will afore annexed on the estate of the said Christorpher
Lotspeich dec'd and having taken the oath of administrating, it is
ordered that Letters is made to them accordingly.
